Introduction to the Terms of Use Agreement

Our online store welcomes you and informs you that the following terms and conditions govern your use of this store and all legal consequences arising from your use of the store’s services through this online platform. Any person using the store, whether as a consumer of its services or products or otherwise, shall be deemed to have agreed to and accepted all provisions of this Agreement, provided that such person has the legal capacity recognized under Sharia law and applicable laws and regulations.

Your use of the store constitutes your acknowledgment of and commitment to the terms and conditions set forth herein. This Agreement applies to all types of transactions between the consumer and the store.

This Agreement becomes effective and enforceable upon your acceptance of its terms and the commencement of the registration process with the store, in accordance with Article 10 of the Saudi Electronic Transactions Law.

Article 1: Introduction and Definitions

The above introduction forms an integral part of this Agreement. The following definitions clarify the key terms used herein:

Store: Refers to all forms of the store available online, including electronic applications, websites, and physical retail stores.
Consumer: A person who engages in electronic commerce for the purpose of obtaining products or services offered by the store through its electronic platform.
Agreement: Refers to these terms and conditions, which govern and regulate the relationship between the parties to this Agreement.

Article 2: Consumer’s Legal Capacity

The Consumer acknowledges that they possess the legal capacity recognized under Sharia law and applicable laws and regulations to transact with the store, or that they are at least eighteen (18) years of age.
The Consumer agrees that, in the event of a violation of this Article, they shall bear the consequences of such violation before third parties.

Article 3: Nature of the Store’s Obligations

The store’s obligation toward consumers is to provide the relevant service or product.
The store may provide additional services, such as after-sales services or other related services, depending on the nature and type of the service or product requested by the Consumer.

Article 4: Rules Governing Use

The Consumer shall use the store’s electronic platform in accordance with public morals and the laws and regulations applicable in the Kingdom of Saudi Arabia.
When purchasing a service or product from the store, the Consumer shall not use such service or product in any manner that violates public morals or the laws and regulations applicable in the Kingdom of Saudi Arabia.

Article 5: Accounts and Registration Obligations

Upon submitting an application to become a member of the store, you are required to disclose certain information and choose a username and confidential password to access the store’s services. By doing so, you agree to the following:

You are responsible for maintaining the confidentiality of your account information and password. You agree to notify the store immediately of any unauthorized use of your account information or any other breach of your confidential information.
The store shall not be liable for any direct or indirect, material or moral losses you may incur as a result of the disclosure of your username or login password.
You agree to use your account or membership personally and accept full responsibility for it. Any use of your account by another person shall be considered evidence that you have authorized that person to use the store in your name and on your behalf.
You agree to use the store seriously and in good faith.
You agree to provide true, accurate, current, complete, and lawful information about yourself as required during registration. You also agree to update your information whenever it changes or when an update is necessary.
Our store undertakes to treat your personal information and contact details with strict confidentiality.
If the store determines that you have provided information that is false, inaccurate, outdated, incomplete, unlawful, or inconsistent with this Agreement, the store reserves the right to suspend, freeze, or terminate your membership, store, or account on the platform, without prejudice to the store’s other rights and lawful remedies to recover its rights and protect other consumers.
In the event of failure to comply with any of the above provisions, the store’s management shall have the right to suspend or terminate your store or membership, or prevent you from accessing the store’s services in the future.

Article 6: Electronic Communications and Official Communication Channels

The parties to this Agreement agree that communication shall take place through the email address registered on the platform.
The Consumer agrees that all agreements, announcements, statements, and other communications provided electronically shall have the same effect as their written counterparts and shall constitute valid evidence for fulfilling applicable legal and Sharia requirements.
The Consumer agrees that the store’s management may contact and notify them of any provisions relating to this Agreement or their transactions with the store by sending general messages to all consumers or specific messages to selected users of the store.

Article 7: Amendments to the Terms of Use Agreement and Fees

If any provision or clause of this Agreement is canceled or becomes invalid or unenforceable, such cancellation or invalidity shall not affect the validity of the remaining provisions, clauses, rules, and terms, which shall remain in effect until otherwise notified by the store’s management.
This Agreement, which may be amended from time to time as circumstances require, constitutes the framework governing the operations, understanding, and agreement between the Consumer and the store.
The store may impose fees on certain consumers depending on the offers, products, or services requested, or on any fees or taxes imposed by the government in relation to the relevant product or service.
The store reserves the right to add, increase, decrease, or deduct any fees or expenses pursuant to the provisions and terms of this Agreement, regardless of the reason for the Consumer’s registration.

Article 8: Payment and Settlement Services

The store provides payment and settlement services through its partners. Payments may be made entirely online using the payment options available on the store or through any other payment method that the store may offer from time to time.
The store undertakes to set the prices of the services or products it offers in accordance with their prevailing market value.
The store undertakes to provide invoices, payment receipts, and acknowledgment of receipt for all amounts and revenues arising from transactions conducted through the store. The store shall also provide the Consumer with an invoice for each purchased service or product.
The store undertakes to maintain generally accepted accounting standards and practices in its online operations, in accordance with this Agreement and in the interest of legal, economic, commercial, and organizational requirements.

Article 9: Intellectual Property

All intellectual property rights relating to the store are exclusively owned by the store, whether such rights existed before the establishment of this electronic platform or were acquired afterward.
The Consumer shall respect the store’s intellectual property rights, including the store’s name, words, logos, symbols, and other materials associated with or displayed on the store. All intellectual property rights associated with the store’s name and identity shall remain the exclusive property of the store.

Article 10: Store Liability

The store undertakes to conduct its commercial activities through this electronic platform lawfully and in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia and the provisions of this Agreement.
The store shall not be responsible for claims arising from errors or negligence, whether direct, indirect, incidental, or attributable to the Consumer or a third party, such as shipping companies.
[Store Name], its employees, owners, and representatives undertake to ensure that the products or services offered are safe, lawful, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia, and are intended for lawful purposes.

Article 11: Restriction of Access or Membership

The store may suspend or terminate a Consumer’s membership or restrict their access to the platform’s services at any time, without prior notice and for any reason, without being required to specify such reason.

Article 12: Applicable Law

This Terms of Use Agreement shall be governed by and interpreted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia. It shall be fully subject to the applicable laws and regulations enforced by the competent authorities in the Kingdom of Saudi Arabia.

Article 13: General Provisions

If any provision or clause of this Terms of Use Agreement is canceled or becomes invalid or unenforceable, such cancellation or invalidity shall not affect the validity of the remaining provisions, clauses, and terms, which shall remain in effect until otherwise notified by the store’s management.

This Terms of Use Agreement, which may be amended from time to time as circumstances require, constitutes the agreement governing the relationship, operations, understanding, agreement, and contractual arrangements between the store and the Consumer. Both parties further agree to the following:

The Arabic language shall be the governing language for interpreting the provisions of this Agreement, including where the Agreement is translated into another language.
All prices displayed for the store’s services or products may be amended from time to time.
Promotional or marketing offers introduced by the store are temporary. The store reserves the right to amend or discontinue such offers at any time.
Both parties undertake to conduct their dealings in a manner that does not violate Sharia principles or the applicable rules, laws, and regulations relevant to the relationship between the store and the Consumer.
This Terms of Use Agreement may only be revoked pursuant to a decision issued by the store’s management.
